Terms of Service

Last updated 3 November 2026

These terms

These terms are an agreement between you and 36 Labs [legal company name] (“we”, “us”), which runs FirstTake. By joining the waitlist, creating an account or using FirstTake, you agree to them. If you use FirstTake for a business, you agree on its behalf and confirm you’re allowed to.

What FirstTake does

FirstTake comes up with ideas for short-form videos, makes them and posts them to the TikTok, Instagram and YouTube accounts you connect, then reports how they perform. FirstTake is in early access: features will change, and some described on our site aren’t available yet.

Your account

Connected social accounts

When you connect a social media account, you let us post to it and read its performance for you. You must have the right to do that, and you remain bound by each platform’s own rules. We aren’t responsible for what a platform does, such as removing a video, limiting its reach or suspending an account.

Your content and the videos we make

What you must not do

We can remove content or suspend an account that breaks these rules.

Plans and payment

Ending your use

You can stop using FirstTake and delete your account at any time. We can suspend or end your access if you break these terms, with notice where we reasonably can.

Our responsibility to you

We provide FirstTake with reasonable care and skill, but we can’t promise it will always be available, error-free or get you a particular number of views or sales.

To the extent the law allows, we aren’t liable for lost profits, revenue or data, and our total liability to you is limited to what you paid us in the 12 months before the claim. Nothing in these terms limits liability that can’t be limited by law, or your statutory rights as a consumer.

Changes and the law

We may update these terms; we’ll update the date at the top and email you before a change that matters takes effect. These terms are governed by the law of [governing law], and disputes go to its courts.

Questions: [contact email]. How we handle your data is in our Privacy Policy.
